Emma's answers to What's an affidavit?

Question

I notice that when marrying abroad the prospective bride and groom have to provide the following: Affidavit stating that both parties are single and free to marry. I understand that this may be carried out through a solicitor. I do not fully understand how you prove that you are single and free to marry. How can this be done?

Answer

An affidavit is a written statement sworn on oath to be true. Once you have signed one of these, stating that you are free to marry, the country you are marrying in should be satisfied. However if this statement is proved to be untrue there could be legal charges placed against you.

Make sure that you definitely need a affidavit. You can find this out by contacting the country's embassy as a number of countries have changed their requirements.
